อัพเดท: มาตรการของรัฐบาลที่เกี่ยวข้องกับสถานการณ์โควิด-19 ในประเทศไทย

คุณอาจทราบแล้วว่าเมื่อวันที่ 25 มีนาคม 2020 รัฐบาลไทยอาศัยอำนาจตามพระราชกำหนดการบริหารราชการในสถานการณ์ฉุกเฉิน พ.ศ. 2548 (2005) ออกประกาศสถานการณ์ฉุกเฉินทั่วราชอาณาจักร เพื่อสกัดการแพร่ระบาดของเชื้อไวรัสโคโรนา (โควิด-19) ในประเทศไทย พระราชกำหนดนี้จะยังคงมีผลบังคับใช้จนถึงวันที่ 30 เมษายน 2020 โดยอาจมีการขยายเวลา

มาตรการระดับประเทศ

ภายหลังจากการประกาศสถานการณ์ฉุกเฉิน รัฐบาลใช้มาตรการและข้อจำกัดหลายประการที่เกี่ยวข้องกับการเดินทางระหว่างประเทศและภายในประเทศ การปิดสถานที่ที่มีความเสี่ยงสูง และการรักษาระยะห่างระหว่างบุคคล เมื่อวันที่ 2 เมษายน 2020 รัฐบาลประกาศ “เคอร์ฟิว” ซึ่งห้ามบุคคลใดทั่วประเทศออกนอกเคหสถานระหว่างเวลา 22:00 น. ถึง 4:00 น. ยกเว้นบางกรณีสำหรับเจ้าหน้าที่ทางการแพทย์ การขนส่งสินค้า ฯลฯ การประกาศดังกล่าวจะมีผลตั้งแต่วันที่ 3 เมษายน 2020 และอาจยกระดับตามสถานการณ์ที่เปลี่ยนแปลง

มาตรการเพิ่มเติมในระดับท้องถิ่น

หน่วยงานในท้องถิ่นที่คุณให้เช่าที่พักอาจมีการบังคับใช้มาตรการเพิ่มเติม

กรุงเทพมหานคร และจังหวัดอื่นๆ ทั่วประเทศออกข้อจำกัดเพื่อรับมือกับการแพร่ระบาดของเชื้อไวรัสในท้องที่ ซึ่งรวมถึงการปิดสถานที่ที่มีความเสี่ยงสูง เช่น ศูนย์การค้า สวนสาธารณะ ตลอดจนโรงแรมและที่พักอื่นๆ สำหรับนักท่องเที่ยว

หากคุณให้เช่าที่พักในภูเก็ต: เมื่อวันที่ 2 เมษายน 2020 จังหวัดภูเก็ตออกคำสั่งที่ 1797/2563 ให้ปิดโรงแรมและสถานประกอบการในลักษณะเดียวกันทั้งหมด ยกเว้นโรงแรมซึ่งทางราชการใช้เป็นโรงพยาบาลสนามหรือสถานที่พักเพื่อสังเกตอาการโควิด-19 คำสั่งนี้ยังใช้ห้ามไม่ให้ที่พักรับผู้เข้าพักใหม่ แม้ว่าจะยังเปิดดำเนินการและมีผู้เข้าพักอยู่ในปัจจุบัน สำหรับที่พักที่ยังมีผู้เข้าพักอยู่ จะต้องแจ้งจำนวนและรายชื่อผู้เข้าพักให้อำเภอทราบ ผู้ฝ่าฝืนต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 100,000 บาท หรือทั้งจำทั้งปรับ คำสั่งมีผลตั้งแต่วันที่ 4 เมษายน 2020
หากคุณให้เช่าที่พักในชลบุรี: เมื่อวันที่ 2 เมษายน 2020 จังหวัดชลบุรีออกคำสั่งที่ 9/2563 ให้ปิดโรงแรมและสถานประกอบการในลักษณะเดียวกันชั่วคราวทั้งหมด จนกว่าสถานการณ์โควิด-19 จะคลี่คลาย นอกจากนี้ สถานประกอบการ รวมถึงผู้ให้บริการที่พัก ยังต้องดำเนินมาตรการป้องกันไม่ให้พนักงาน/ลูกจ้างของตนเดินทางออกนอกจังหวัด ผู้ฝ่าฝืนต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 100,000 บาท หรือทั้งจำทั้งปรับ คำสั่งมีผลโดยทันที
หากคุณให้เช่าที่พักในพังงา: เมื่อวันที่ 2 เมษายน 2020 จังหวัดพังงาออกคำสั่งที่ 7/2563 ให้ปิดโรงแรม รีสอร์ท และสถานประกอบการในลักษณะเดียวกันทั้งหมด ยกเว้นที่มีผู้เข้าพักก่อนวันที่คำสั่งมีผลบังคับใช้ และโรงแรมซึ่งทางราชการใช้เป็นโรงพยาบาลสนามหรือสถานที่พักเพื่อสังเกตอาการโควิด-19 หรือเพื่อวัตถุประสงค์อื่น สำหรับที่พักที่มีผู้เข้าพักอยู่ก่อนที่คำสั่งนี้มีผลใช้บังคับ ให้พักต่อไปจนกว่าผู้เข้าพักจะเช็คเอาท์จนหมดแล้ว จึงให้ปิดดำเนินการทันที โดยไม่มีการรับผู้เข้าพักเพิ่มอีก คำสั่งมีผลตั้งแต่วันที่ 4 เมษายน 2020
หากคุณให้เช่าที่พักในกระบี่: เมื่อวันที่ 3 เมษายน 2020 จังหวัดกระบี่ออกคำสั่งที่ 8/2563 ให้ปิดโรงแรม รีสอร์ท และสถานประกอบการในลักษณะเดียวกันทั้งหมด ยกเว้นที่มีผู้เข้าพักก่อนวันที่คำสั่งมีผลบังคับใช้ สำหรับที่พักที่มีผู้เข้าพักอยู่ก่อนที่คำสั่งนี้มีผลบังคับใช้ ให้ย้ายผู้เข้าพักไปยังที่พักที่รัฐบาลกำหนดภายในวันที่ 10 เมษายน 2020 หลังจากนั้นที่พักจะต้องปิดดำเนินการทันที ขณะย้ายผู้เข้าพักไปยังที่พักที่รัฐบาลกำหนด ผู้ประกอบการที่พักจะต้องแจ้งจำนวนและรายชื่อผู้เข้าพักให้อำเภอทราบ คำสั่งมีผลตั้งแต่วันที่ 4 เมษายน 2020
หากคุณให้เช่าที่พักในประจวบคีรีขันธ์: เมื่อวันที่ 3 เมษายน 2020 จังหวัดประจวบคีรีขันธ์ออกคำสั่งที่ 3861/2563 ให้ปิดโรงแรมและสถานประกอบการในลักษณะเดียวกันทั้งหมด ยกเว้นโรงแรมซึ่งทางราชการใช้เป็นโรงพยาบาลสนามหรือสถานที่พักเพื่อสังเกตอาการโควิด-19 หรือเพื่อวัตถุประสงค์อื่น สำหรับที่พักที่มีผู้เข้าพักอยู่ก่อนที่คำสั่งนี้มีผลใช้บังคับ ให้พักต่อไปจนกว่าผู้เข้าพักจะเช็คเอาท์จนหมด และจะต้องแจ้งจำนวนและรายชื่อผู้เข้าพักให้อำเภอทราบ เมื่อผู้เข้าพักเช็คเอาท์จนหมดแล้ว จึงให้ปิดดำเนินการทันที โดยไม่มีการรับผู้เข้าพักเพิ่มอีก คำสั่งมีผลโดยทันที
หากคุณให้เช่าที่พักในนครราชสีมา: เมื่อวันที่ 6 เมษายน 2020 จังหวัดนครราชสีมาออกคำสั่งที่ 3593/2563 ให้ปิดโรงแรมทุกประเภท สำหรับโรงแรมที่มีผู้เข้าพักอยู่ก่อนที่มีคำสั่งนี้ ให้พักต่อไปจนกว่าผู้เข้าพักจะเช็คเอาท์จนหมด และจะต้องแจ้งจำนวนและรายชื่อผู้เข้าพักให้อำเภอทราบ เมื่อผู้เข้าพักเช็คเอาท์จนหมดแล้ว ต้องไม่มีการรับผู้เข้าพักเพิ่มอีก คำสั่งมีผลตั้งแต่วันที่ 7 เมษายน 2020
หากคุณให้เช่าที่พักในเพชรบุรี: เมื่อวันที่ 8 เมษายน 2020 จังหวัดเพชรบุรีออกคำสั่งที่ 595/2563 ให้ปิดโรงแรมที่ได้รับอนุญาตและไม่ได้รับใบอนุญาตประกอบธุรกิจโรงแรมทุกประเภท สถานที่พักที่ไม่เป็นโรงแรมทั้งที่ได้รับอนุญาตและไม่ได้รับอนุญาต ที่พักประเภทพูลวิลล่า คอนโดมิเนียมที่ประกอบธุรกิจโรงแรม อพาร์ทเมนท์ บ้านพัก ห้องเช่า หรือสถานประกอบการในลักษณะให้เช่าพักรายวัน โรงแรมและที่พักสามารถให้ที่พักแก่แขกที่พักอยู่ก่อนที่จะมีคำสั่งนี้เท่านั้น และต้องแจ้งจำนวน รายชื่อ และวันเช็คเอาท์ของแขกให้อำเภอทราบ ทั้งนี้ ที่พักต้องไม่มีการรับผู้เข้าพักเพิ่มอีกหลังจากวันที่ 8 เมษายน 2020 เหตุเพราะคำสั่งดังกล่าวมีผลโดยทันที จนถึงวันที่ 31 พฤษภาคม 2020

Update: Government measures relating to COVID-19 in Thailand

As you may know, on 25 March 2020, the Thai government invoked the Emergency Decree on Public Administration in Emergency Situation, B.E. 2548 (2005) to declare a nationwide state of emergency to contain the coronavirus (COVID-19) outbreak in the country. The decree will remain in effect until 30 April 2020, with the possibility of extension.

National-level measures

Several measures and restrictions related to international and domestic travel, high-risk venue closure, and social distancing, have been put in place by the government. Most recently, on 2 April 2020, the government announced a curfew that bans all people nationwide from leaving their homes from 10pm to 4am, with certain exceptions for medical staff, transportation of goods, etc. The announcement is effective from 3 April 2020, and could escalate depending on how the situation evolves.

Additional local-level measures

The local authority where you are hosting may have implemented additional measures that may apply to you.

The Bangkok Metropolitan Administration (BMA) and other provincial administrations across the country have been issuing their own restrictions to cope with the virus outbreak in each of their localities, which also includes the closure of high-risk venues such as shopping centers, public parks, as well as hotels and other tourist accommodation.

If you are hosting in Phuket: On 2 April 2020, the Phuket Provincial Administration issued Order No. 1797/2563 to close down all hotels and similar operations, except for those being used by the government as field hospitals and for observation of COVID-19 symptoms. The order also prohibits accommodations that are still open and have guests from accepting new guests. For accommodations with guests, they must report numbers of guests and their names to the local district offices. Violations could result in up to 1 year imprisonment or up to 100,000 baht fine, or both. The order became effective from 4 April 2020.
If you are hosting in Chonburi: On 2 April 2020, the Chonburi Provincial Administration issued Order No. 9/2563 to temporarily close down all hotels and hotel-like operations until the COVID-19 situation improves. Business operators, including accommodation providers, are also required to carry out measures to prevent their employees from leaving the province. Violators could face up to 1 year imprisonment or up to 100,000 baht fine, or both. The order was effective immediately.
If you are hosting in Phang Nga: On 2 April 2020, the Phang Nga Provincial Administration issued Order No. 7/2563 to close down all hotels, resorts or other similar operations, except for those that have guests prior to the date the order becomes effective, and those being used by the government as field hospitals, for observation of COVID-19 symptoms, or for other purposes. Accommodation with guests prior to the date the order becomes effective can host their guests until all of them check out, after which they must stop their operation immediately without accepting new guests. The order became effective from 4 April 2020.
If you are hosting in Krabi: On 3 April 2020, the Krabi Provincial Administration issued Order No. 8/2563 to close down all hotels, resorts or other similar operations, except for those that have guests prior to the date the order becomes effective. For accommodation with guests prior to the date the order becomes effective, guests must be moved to the accommodation designated by the government by 10 April 2020, after which the accommodation must stop its operation immediately. While guests are being moved to the government-designated accommodation, accommodation operators must also report the numbers of guests and their names to the local district offices. The order became effective from 4 April 2020.
If you are hosting in Prachuap Khiri Khan: On 3 April 2020, the Prachuap Khiri Khan Provincial Administration issued Order No. 3861/2563 to close down all hotels and similar operations, except for those being used by the government as field hospitals, for observation of COVID-19 symptoms, or for other purposes. Accommodation with guests prior to the date the order is issued can host their guests until all of them check out, and must report their numbers of guests, their names, and their check-out dates to the local district offices. After all guests checked out, accommodation must stop their operation without accepting new guests. The order became effective immediately.
If you are hosting in Nakhon Ratchasima: On 6 April 2020, the Nakhon Ratchasima Provincial Administration issued Order No. 3592/2563 to close down all types of hotels. Hotels with guests prior to the date the order was issued can host guests until all of them check out, and must report numbers of guests, their names, and their check-out dates to the local district offices. After all guests have checked out, the accommodation must not accept new guests. Note that only hotels with a proper plan and COVID-19 prevention measures approved by the local authorities can continue to operate. The order became effective from 7 April 2020.
If you are hosting in Phetchaburi: On 8 April 2020, the Petchaburi Provincial Administration issued Order No. 595/2563ordering all types of licensed and unlicensed hotels, registered and unregistered non-hotel accommodation, pool villas, condominiums operating hotel business, apartments, guesthouses, rental rooms, or daily rental operations to cease operations. Hotels and accommodations can only host guests who checked in prior to the issuance of the order, and must report numbers of guests, their names, and their check out dates to the relevant local district offices. Accommodations must not accept new guests after 8 April 2020 as the order took immediate effect and will remain in place until 31 May 2020.
